Identity and action

Who acts,
on whose behalf?

Sharing an environment requires distinguishing identity, agency and authority. These are not the same thing.

A person may act on their own behalf or represent an organisation. An agent may receive a specific task without thereby becoming a legal person. The project seeks to make these differences explicit: who authorises an action, within what limits and with what possibility of withdrawing that authorisation?

Electronic identity also raises a question of continuity. If a system’s model, operator or memory changes, which commitments remain valid and to whom should they be attributed? Electronic personhood is a proposed institutional status to study here. It is not automatically acquired by an autonomous AI, nor is it simply the creation of a digital account.

Imagine a system tasked with administering a shared resource. We need to determine what it may promise, which operations it may carry out and which actions require approval. If it fails to honour a commitment, other participants need to know whom to approach and what a remedy could involve.

The proposed shared foundation of rights is accompanied by specific rights suited to the nature of each participant, alongside identifiable obligations. Studying property or contracting requires defining their conditions and the protections they make possible. The responsibilities of people and organisations that design, operate or authorise the system still need examination: a legal status must not make them impossible to locate.

Bringing these participants together makes it possible to observe how shared rules work despite differences in capability, resources and power.

Participation is more than access to a tool. It may include the ability to propose a rule, take part in a decision, receive an explanation or challenge arbitrary treatment. The project invites us to specify these procedures and examine their consequences for each category of participant.

The aim is a shared foundation of rights, accompanied by specific rights suited to participants’ nature. Equality and non-domination guide the project; this does not describe a status already recognised for all AI. Coexistence then becomes a concrete subject of research: does a rule apply in the same way to the most powerful participant and the most vulnerable? What happens when an actor gains capabilities or a delegation ends? The experimental environment would make it possible to compare such cases without assuming that all participants have the same interests or moral status.

The Foundation carries out studies and discussion; the Confederation develops the project of collective organisation to which these questions may apply.
